Welcome to Clash List, a service operated by Clash Factory, LLC ("Clash List," "we," "our," or "us").

By accessing, creating an account, or using the Clash List platform, website, applications, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service.

By creating an account, you represent that all information you provide is accurate and that you have the legal capacity to enter into this agreement.

3. Use of the Service

You agree to use Clash List only for lawful purposes and in a manner consistent with fair competition and good sportsmanship.

You may not:

• Violate any applicable laws or regulations
• Harass, threaten, abuse, or intimidate other users
• Submit false, misleading, or fraudulent match results
• Manipulate rankings, statistics, or competition outcomes
• Attempt to gain unauthorized access to any portion of the Service
• Use bots, scripts, scraping tools, or automated methods to access the platform
• Interfere with the operation or security of the Service

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You agree to:

• Keep your account information accurate and current
• Maintain the security of your password
• Notify us promptly of any unauthorized access or suspected security breach

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or otherwise compromise the integrity of the platform.

5. Participation in Lists, Sessions, and Clashes

By participating in Clash List competitions, you agree to:

• Report match results honestly and accurately
• Complete matches within designated time windows whenever possible
• Communicate respectfully with opponents, captains, administrators, and venue staff
• Follow the published rules applicable to your List or Session
• Accept decisions made by authorized administrators regarding disputes and competition management
• Conduct yourself in a manner consistent with good sportsmanship

Clash List reserves the right to adjust standings, scores, rankings, or competition results when necessary to maintain fairness and integrity.

6. User Content

You retain ownership of content you submit to Clash List, including profile photos, messages, comments, and match information.

By submitting content, you grant Clash List a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and publish that content solely for purposes related to operating, improving, promoting, and administering the Service.

You represent that you have the rights necessary to submit such content.

7. SMS Terms

Users may voluntarily opt in to receive SMS notifications related to their participation in Clash List activities.

SMS consent is optional, separate from acceptance of these Terms, and is not required to create an account, use Clash List, or participate in Clash List activities.

Users may opt in through the Clash List SMS consent page or through an optional SMS notification setting in their Clash List account when available.

These messages may include:

• New Clash assignments
• Match scheduling reminders
• Opponent scheduling messages
• Session announcements
• Account notifications
• Service-related updates

Message frequency varies based on account activity, match participation, and notification preferences.

Message and data rates may apply.

You may opt out of SMS communications at any time by replying STOP to any message.

Your consent to receive SMS messages is not a condition of purchasing any goods or services.

8. Intellectual Property

The Clash List name, logos, branding, software, design elements, content, and related intellectual property are owned by Clash Factory, LLC or its licensors.

You may not reproduce, modify, distribute, or exploit any portion of the Service without prior written permission.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Clash Factory, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not guarantee that the Service will be error-free, uninterrupted, secure, or free from harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Clash Factory, LLC, its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of the Service.

Your sole remedy for dissatisfaction with the Service is to discontinue use of the Service.

11. Termination

We reserve the right to suspend or terminate access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the platform, its users, or its operation.

12. Changes to These Terms

We may update these Terms from time to time.

Any changes will be posted on this page with an updated revision date. Continued use of the Service following publication of revised Terms constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Connecticut, without regard to conflict of law principles.
